Ohneschach (Checkless chess?) - perpetual checkmate?

The following position has raised arguments when presented firstly. What do you think about it?

(= 5+3 )

= Nightrider

Gerd Rinder
Die Schwalbe 1, October 1969, p.9

Mate in one, Ohneschach (checkless chess?)

Note: In "Ohneschach" no party may give check except it is checkmate.

Solution: 1.Rde8 mate

What if white plays 1.Rhe8? Is it checkmate since black isn't allowed to check white? Can black play 1...Kd5, checkmating white? If he does so, can white play 2.Ke7, checkmating black again? Will this lead to a draw by perpetual checkmate?

The question was raised in 1969 but I still think it's very interesting.
